Every driver operating a commercial motor vehicle that requires a CDL is subject to DOT random drug and alcohol testing. Owner-operators must participate in a consortium/third-party random testing pool — an employer cannot administer its own random program for a single driver.
Minimum random rates — 49 CFR 382.305
The FMCSA minimum annual random rates are 50% of average driver positions for drugs and 10% for alcohol. Selection must be scientifically valid — every driver has an equal chance in each selection period, and employer-directed selection is prohibited.
Part 40 procedures
All collections follow 49 CFR Part 40 — chain of custody, split-specimen collection, and temperature verification — and every non-negative result is reviewed by a qualified Medical Review Officer before it is reported.
Recordkeeping and the Clearinghouse
DOT requires specific records to be retained and, for CDL drivers, pre-employment and annual FMCSA Clearinghouse queries. We keep the records and coordinate the queries so nothing lapses.
