49 CFR Part 40, Subpart L establishes alcohol testing requirements:

  • Testing must use evidential breath testing (EBT) devices on the NHTSA Conforming Products List
  • Breath Alcohol Technicians must be trained in EBT operation and quality assurance
  • Post-accident alcohol testing must occur within 8 hours or be documented
  • Random alcohol testing minimum rate is 10% annually
  • Screening results of 0.02 or greater require 15-minute wait and confirmation test
  • Confirmed result of 0.04 or greater is a DOT violation
