Return-to-Duty & Follow-Up Testing

Complete SAP case management and follow-up testing coordination. From SAP referral through return-to-duty testing and ongoing follow-up monitoring—we manage the entire process to get drivers back to work safely.

The return-to-duty process is complex and unforgiving. A driver who has violated DOT drug and alcohol regulations must complete SAP evaluation, recommended treatment, a negative RTD test, and a minimum of six directly observed follow-up tests over 12 months. Missing any step or failing to report milestones to the Clearinghouse triggers new violations and restarts the entire process.

Diversified Drug Testing manages complete RTD programs. We coordinate SAP referrals, track treatment completion, schedule the return-to-duty test immediately after SAP clearance, and administer the follow-up testing plan per SAP requirements. Automated reminders ensure no deadline is missed, and all milestones are properly reported to the FMCSA Clearinghouse.

All RTD and follow-up tests are directly observed as required by regulation. We coordinate same-gender observers at all collection sites and ensure proper documentation throughout the process.

Compliance Requirements

Compliance Requirement

49 CFR Part 40, Subpart O establishes return-to-duty requirements:

  • Driver must be evaluated by a DOT-qualified Substance Abuse Professional (SAP)
  • Driver must complete SAP-recommended education and/or treatment
  • Return-to-duty test (directly observed) must be negative before returning to safety-sensitive duties
  • Minimum 6 directly observed follow-up tests over first 12 months
  • SAP may require additional tests and extend follow-up period up to 60 months
  • All milestones must be reported to FMCSA Clearinghouse

Frequently Asked Questions

A minimum of 6 directly observed follow-up tests must be conducted over the first 12 months. However, the SAP may require additional tests and extend the follow-up period up to 60 months based on clinical assessment. Diversified Drug Testing manages the testing schedule per SAP requirements.

A positive follow-up test requires immediate removal from safety-sensitive duties and restarts the entire RTD process, including a new SAP evaluation, treatment, and follow-up plan.

Yes. All return-to-duty and follow-up tests must be directly observed collections, meaning a same-gender collector directly observes the specimen being provided. This is a non-negotiable DOT requirement.

We report all required milestones to the FMCSA Clearinghouse, including RTD test completion, follow-up test results, and SAP determination changes. This ensures the driver's Clearinghouse record accurately reflects their status.
